Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and WHOX Limited ("WHOX", "we", "us", or "our"). By accessing or using the WHOX website (whox.com), the WHOX Vigil browser extension, the WHOX API, or any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Services.

"Services" means the WHOX website, WHOX Vigil browser extension, WHOX API, and all associated products, features, and functionalities. "Content" means all text, graphics, data, software, and other materials provided through the Services. "User Data" means any data processed through the Services as described in our Privacy Policy. "Subscription" means any paid service tier providing enhanced features or API access.

WHOX provides privacy analysis and digital identity assessment tools, including:

• •Trust Score: A composite score (0-100) assessing digital fingerprint uniqueness and privacy posture
• •Fingerprint Analysis: Detection and analysis of browser fingerprinting vectors
• •Leak Detection: Identification of WebRTC, DNS, and other potential data leaks
• •WHOX Vigil: Browser extension providing tracker blocking, fingerprint protection, and censorship monitoring
• •API Access: Programmatic access to WHOX analysis capabilities (subject to separate API Terms)

The Services are provided for informational and educational purposes. Results should not be relied upon as the sole basis for security decisions.

You must be at least 16 years of age to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Some Services, in particular the WHOX API, require an API key. If you obtain an API key:

• •You must provide accurate contact information when requesting the key, so we can reach you about abuse, security issues, and material changes to the API
• •You are responsible for keeping your API key confidential and treating it with the same care as a password
• •You are responsible for all requests made with your API key, including any usage by your employees, contractors, or downstream applications
• •You must notify us immediately at support@whox.com if you suspect your API key has been exposed, leaked, or misused
• •We may rotate, suspend, or revoke API keys that violate these Terms, exceed rate limits, or generate abusive traffic. The website (whox.com) and the WHOX Vigil browser extension can be used anonymously and do not require an API key.

You agree to use the Services only for lawful purposes. You shall NOT:

• •Use the Services to violate any applicable law, regulation, or third-party rights
• •Attempt to gain unauthorized access to any part of the Services or related systems
• •Interfere with or disrupt the integrity or performance of the Services
• •Attempt to reverse engineer, decompile, or disassemble any part of the Services
• •Use the Services to develop a competing product or service
• •Exceed API rate limits or engage in automated scraping without authorization
• •Use the Services for any form of illegal surveillance or tracking
• •Resell, redistribute, or sublicense access to the Services without authorization
• •Submit false, misleading, or fraudulent data to the Services

If you use the WHOX API:

• •API access is subject to rate limits specified in your subscription tier
• •API keys are confidential and must not be shared or published
• •You may not use the API to build a substantially similar service
• •We may modify, suspend, or discontinue API access at any time
• •Excessive usage or abuse may result in immediate termination

For paid subscription services:

• •Subscription fees are charged in advance on a recurring basis (monthly or annually)
• •All fees are non-refundable except as required by applicable law
• •We may change subscription pricing with 30 days notice
• •You may cancel your subscription at any time; access continues until the end of the billing period
• •Failure to pay may result in suspension or termination of Services

All Content and the Services are owned by WHOX or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Services or Content without prior written consent. The WHOX name, logo, and all related marks are trademarks of WHOX Limited.

If you provide feedback, suggestions, or ideas regarding the Services, you grant WHOX a worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate such feedback into the Services without compensation or attribution.

The Services may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is governed by their respective terms and policies.

You agree to indemnify, defend, and hold harmless WHOX and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.

We may suspend or terminate your access to the Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware. Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction.

We reserve the right to modify these Terms at any time. Material changes will be announced via the WHOX website at least 30 days before taking effect. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Services.

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of WHOX.

These Terms, together with our Privacy Policy and any additional terms for specific Services, constitute the entire agreement between you and WHOX regarding the Services and supersede all prior agreements and understandings.
